PRIVACY POLICY FOR MANAGING REQUESTS FOR ASSISTANCE FROM USERS OF BANCOMAT S.p.A. SERVICES

Pursuant to art. 13 of Regulation 2016/679/EU (”GDPR”), we inform you that BANCOMAT S.p.A., with sole office in Piazzale Luigi Sturzo 15, 00144, Rome, as data controller (”ATM” or”titular”), will process personal data (”Data”) transmitted by you for the sole purpose of providing you with the requested information. In particular, your data will be processed:

  • pursuant to art. 6, paragraph 1, letter b) GDPR, to satisfy user contact requests by virtue of the existing relationship with BANCOMAT in relation to the service to which they have joined or intend to join;
  • pursuant to art. 6, paragraph 1, letter f) GDPR, to pursue BANCOMAT's legitimate interest in managing, at every stage, any complaints and disputes.

The Data you spontaneously provide and any additional Data that may be requested by Bancomat during the management of your request will be used by the Data Controller for the sole purpose of following up on the request itself. The provision of such Data is not mandatory but necessary and, therefore, the decision not to communicate them may prevent the Data Controller from providing correct and timely response to your request.

The Data will be processed with automated and non-automated tools, by specifically authorized and specially trained personnel and with logic strictly related to the processing purposes and, in any case, in order to guarantee their security and confidentiality. Adequate security measures are observed to prevent data loss, illegal use and unauthorized access.

Your Data will be kept for the time strictly necessary to fully respond to your request and, subsequently, irreversibly anonymized or securely deleted. If necessary, the Data may be kept and used for the duration of any dispute.

Duly authorized BANCOMAT employees and collaborators who are responsible for customer service and who, with their activities and specific technical skills, help to correctly process the submitted request, supporting customer service, may become aware of your data. The Data may also be communicated to those subjects, who, as data processors pursuant to art. 28 of the GDPR, provide BANCOMAT with services instrumental to carrying out their business (for example, suppliers of IT services and/or applications and management used internally) or to the banking institution participating in the BANCOMAT® brand payment circuits with which you yourself have a contractual relationship and by virtue of which you access the services offered by BANCOMAT. In any case, the Data will not be subject to “dissemination”, meaning transmission to undetermined subjects.

Data processing outside the European Union is not envisaged.

Each interested party retains the right to exercise, in cases permitted by law, at any time, free of charge and without formalities, the rights referred to in articles 15 to 22 of the GDPR, including: the right to request access to personal data, the correction or cancellation of the same and the limitation of the processing that concerns them. Each interested party also has the right to object, at any time, for reasons related to their particular situation, to the processing of personal data concerning them pursuant to art. 6, paragraph 1, letter f) GDPR. Requests relating to the exercise of these rights should be addressed to BANCOMAT S.p.A., with headquarters in Piazzale Luigi Sturzo 15, 00144, Rome; e-mail: privacy@bancomat.it. In response to these requests, the Data Protection Officer appointed by BANCOMAT pursuant to articles 37 et seq. of the GDPR is appointed by the Data Protection Officer and can always be contacted at the same address.

Interested parties who believe that the processing of the Personal Data relating to them carried out with reference to what is specified in this information occurs in violation of the provisions of the GDPR have the right to lodge a complaint with the Guarantor Authority for the protection of personal data (www.garanteprivacy.it), as required by art. 77 of the GDPR itself, or to go to appropriate courts (art. 79 of the GDPR).
